Biomass package: what the new flexibility rules mean for biomethane CHP.

With the biomass package, the legislator has realigned the EEG for biogas and biomethane. The new rules have applied since state aid approval in September 2025.

What has been decided

  • The flexibility supplement rises from €65 to €100 per kilowatt of installed capacity.
  • Eligible operating quarter-hours are remunerated instead of maximum rated capacity.
  • The second remuneration period for existing plants is extended from ten to twelve years.
  • Tender volumes were raised substantially for 2025 and 2026 and decline again afterwards.
  • New biomethane plants have a separate tender segment that only covers highly flexible new plants.

What it means for biomethane CHP

Flexibly operated plants earn more per kilowatt hour. Plants that cannot run flexibly lose profitability. For biomethane in CHP, the operating mode becomes the key lever, alongside the comparison with other outlets such as the fuel market.

Evidence via the German Biogas Register and the requirements of the biomass power sustainability ordinance remain unchanged. With more flexible operation, however, the demands on time-accurate allocation of volumes and certificates increase.

What to do now

  • Review the plant’s flexibility options: overbuild, storage, schedule.
  • Compare power generation with other markets using current figures.
  • Align certificate bookings with the more flexible operating mode.

How power generation from biomethane works in principle is described on the Power market page. Power market
