ETS 2 delayed to 2028: what it means for biomethane.

The start of EU emissions trading for buildings and transport has been delayed by one year to 2028. For biomethane, this changes the timetable more than the principle.

What has been decided

In November 2025, EU member states agreed to move the start of ETS 2 from 2027 to 2028. Regulation (EU) 2026/667 has since put the delay into law. The first European allowances will therefore only have to be surrendered by 31 May 2029.

In Germany, the Fuel Emissions Trading Act (BEHG) remains fully applicable in 2027. Reporting and surrender obligations under national emissions trading continue unchanged for another year. How the price will be set in 2027 is still open.

What it means for biomethane

  • Biomethane with sustainability evidence continues to be rated with an emission factor of zero under nEHS. The relief lever remains, only under national law.
  • Anyone who had already switched their processes to ETS 2 must report under BEHG once more for 2027.
  • The move from a fixed price corridor to free price formation is postponed. That makes long-term calculations harder on both sides.
  • Requirements for evidence and delineation against the GHG quota and the EEG stay the same.

What to do now

Plan 2027 as a further nEHS year: monitoring plan, emissions report and evidence under national rules. Prepare the switch to ETS 2 in parallel so there is no gap in 2028. Biomethane supply contracts should be worded so that they apply regardless of the scheme.
